Privacy policy

When you contact me or come to therapy with me, you entrust me with personal information. Here you can read which information I process, why, and what rights you have.

Data controller

Psychologist Marlene Lyby, PhD (CVR 43965549) is the data controller for the personal data processed in connection with my practice and this website. My contact details are at the bottom of the page.

As a psychologist, I have a duty of confidentiality. What you tell me stays between us, unless you give permission otherwise or the law requires it.

What information I process

When you contact me

When you call, send a text message or write an email, I process the information you give me – typically your name, phone number, email address and what you write about.

Ordinary email is not encrypted. So please avoid writing sensitive information about your health in an email – we can talk about it on the phone or in a session.

When you book a session

Bookings are made in the EasyPractice booking system. It records your name, your contact details and the times of your sessions.

When you attend therapy

As an authorised psychologist, I am required to keep clinical records. The records contain information about you and your course of therapy, including health information. If you take part in data-informed therapy, you answer questions in the Neuwell app, and your answers become part of your therapy.

When you pay

I issue an invoice with your name, your address and the service you have received.

I process your information in order to respond to your enquiry, plan and carry out your therapy, keep clinical records and collect payment.

  • Contact, booking and invoicing are necessary to enter into and fulfil the agreement with you (Article 6(1)(b) of the General Data Protection Regulation, GDPR).
  • Record-keeping and the retention of accounts are necessary to comply with legal requirements (Article 6(1)(c)).
  • Health information is processed as part of treatment and under the duty of confidentiality (Article 9(2)(h)).

Who I share information with

I never sell your information and do not share it for marketing.

  • Suppliers: EasyPractice (booking), Microsoft 365 (email), bunny.net (website hosting) and Neuwell ApS (neuwell.dk), which provides the app for data-informed therapy, process information on my behalf and only on my instructions. Neuwell ApS is owned by me.
  • Subsidies: If you would like a subsidy from the Danish health insurance “Sygeforsikring danmark” or from an insurance company, I only pass on the necessary information by agreement with you.
  • Authorities: Only if the law requires me to.

How long I keep information

  • Enquiries that do not lead to a course of therapy are deleted once they have been answered and are no longer relevant.
  • Clinical records are stored securely for 5 years, as the legislation for psychologists requires.
  • Invoices and accounting records are kept for 5 years under the Danish Bookkeeping Act (bogføringsloven).

The website and cookies

This website does not use cookies, visitor statistics or tracking, and the fonts are served from the website itself.

The website is hosted by the European provider bunny.net. When you visit the site, bunny.net processes technical information, such as your IP address, in order to deliver the site. IP addresses are anonymised in bunny.net’s logs, which are kept for only a few days.

When you click through to, for example, the booking system, Google Maps or Spotify, those services’ own privacy policies apply.

Your rights

You have the right to:

  • access the information I process about you
  • have incorrect information corrected
  • have information deleted when I am no longer required to keep it
  • restrict the processing or object to it
  • receive your information in a common format (data portability)

Contact me if you would like to exercise your rights.

Complaints

You can complain about how I handle your personal data to the Danish Data Protection Agency (Datatilsynet) at datatilsynet.dk. I would always like to hear from you first, though, so we can find a solution together.
